Statewide Gun Registration, Ammo ‘Control’ Bill Introduced In Illinois

The following Illinois gun/ammo “control” legislation made headlines in February, but it’s making the rounds again this week (probably due to its outrageousness?). From a press release on the website of Illinois State Representative Kelly Cassidy (D-Chicago):

CHICAGO, IL – State Rep. Kelly Cassidy (D-Chicago) introduced a bill requiring the registration of firearms in the State of Illinois.

“We’ve dealt for too long with gun violence in our neighborhoods, most often perpetrated by individuals who acquired the firearm through illicit means,” Cassidy said. “Registration is a common sense policy that ties the weapon to its buyer, preventing the types of straw purchasing that put guns into criminals hands. According to a University of Chicago Crime Lab Report, 45% of firearms used in crimes in our state were purchased legally in Illinois and then illegally transferred. Registration creates a safeguard against these transfers and significantly hinders the ability for criminals to acquire firearms.”

HB 4715, the Firearms Registration Act, would require registration of firearms upon purchase, and for firearms owned at the time of passage. The registration process would include a background check, and transfer to an individual without complying with registration would be a Class 2 felony…

Not only is Illinois House Bill 4715 calling for a gun registry, but also ammunition “control” as well. From the bill’s status page on the Illinois General Assembly website:

Creates the Firearms Registration Act. Provides that every person in the State must register each firearm he or she owns or possesses in accordance with the Act. Provides that a person shall not purchase or possess ammunition within this State without having first obtained a registration certificate identifying a firearm that is suitable for use with that ammunition, or a receipt demonstrating that the person has applied to register a suitable firearm under the Act and that the application is pending

Since February 5, the bill has been with the House Rules Committee.

My guess is that it will emerge shortly after the next high-profile mass shooting.

Illinois Gun Owners To March, Lobby In State Capital Tomorrow

Wendesday, March 5, is Illinois Gun Owner Lobby Day, or IGOLD. From the Illinois State Rifle Association website this morning:

All Illinois gun owners are invited to join in Illinois Gun Owners Lobby Day (IGOLD) in Springfield in 2014. This is an annual event where everyone goes to lobby` their representatives in the Illinois House and Senate. IGOLD is sponsored by ISRA and IllinoisCarry.com. Other participating organizations are, Guns Save Life, Sangamon County Rifle Association, and the McHenry County Right To Carry Association. Get your local organization involved as well!

Republican Candidates For Illinois Governor Split On ‘Assault Weapons’ Ban?

This November, an election will be held for Governor of Illinois. The four Republican candidates for the office- State Senators Bill Brady, Kirk Dillard, State Treasurer Dan Rutherford, and businessman Bruce Rauner- were recently given campaign questionnaires by the Associated Press, in which gun rights was one of the topics.

According to the AP, two of the four candidates may support a ban on so-called “assault weapons.”

From last Tuesday:

In a campaign questionnaire for The Associated Press, the four candidates — state Sens. Bill Brady and Kirk Dillard, state Treasurer Dan Rutherford and businessman Bruce Rauner — all said gun rights need to be protected but that some public safeguards should exist.

The four differed over assault-style guns — high-capacity weapons that have been used in some of the deadliest mass shootings. They currently aren’t illegal statewide, and a proposed statewide ban backed by Democratic Gov. Pat Quinn was pulled from consideration last year in Springfield…

Dillard, of Hinsdale, and Rauner, of Winnetka, both left open the possibility they would support a ban. Rutherford, of Chenoa, and Brady, of Bloomington, oppose such a ban

However, the Chicago Sun-Times website is reporting that only one of the four candidates may be open to an “assault weapons” ban. Natasha Korecki wrote last Thursday:

Three of the four Republicans competing in the gubernatorial primary say they believe all Illinois residents have the right to own assault weapons.

Illinois Treasurer Dan Rutherford of Chenoa, state Sen. Bill Brady of Bloomington and venture capitalist Bruce Rauner of Winnetka said Thursday night that they believe it’s a right…

Only Dillard sidestepped the question — saying he believed it was better left up to the federal government to decide…

So what about Rauner? The Associated Press did think his questionnaire answer was “more vague” than Dillard’s. Turning back to their piece:

Rauner gave a more vague answer, saying he supports background checks that keep guns away from criminals and people with mental illness.

“Going beyond that requires a very careful balance between promoting public safety and protecting constitutional rights,” Rauner wrote…

Unless Kirk Dillard and Bruce Rauner actually come out and say they are against a state AWB, I would chalk them up as possibly being in support of an “assault weapons” ban if the political winds were blowing in that direction.

Highland Park, Illinois, Sued For Banning ‘Assault Weapons’

Earlier this year, a number of Illinois municipalities passed “assault weapon” bans.

One of these towns was Highland Park, on Chicago’s far North Shore. From a July 2 press release:

The Highland Park City Council passed an ordinance banning assault weapons within City-limits at the June 24 City Council Meeting, after hearing from many residents, interest groups and individuals offering perspective on all sides of the issue, in writing and in person. The ban, modeled after Cook County’s assault weapons ordinance, would amend Chapter 134 of the City Code. The ordinance was effective July 8, 2013. Residents have 90 days to comply with the provisions set within the ordinance…

Having worked closely with a number of Highland Park city hall staff some years back as the assistant to the mayor of a neighboring town, I remember thinking to myself, “I wonder if those guys are going to miss all that money that could be pissed away in the coming lawsuit.”

Fast forward to the other day, when the Associated Press reported the City of Highland Park is being sued for its new “assault weapons” ban. From the website of Chicago ABC affiliate Channel 7 on December 20:

A gun rights group has filed its first lawsuit against one of the Illinois communities that rushed to pass an assault weapons ban before a state law allowed people to carry concealed weapons in public, and the group strongly hinted Friday that the lawsuit will not be its last.

“I am not at liberty to talk about (other possible lawsuits), but let’s just say we’re always working,” said Richard Pearson, the executive director of the Illinois State Rifle Association, which joined the lawsuit filed by a Highland Park pediatrician against the well-to-do community north of Chicago. “We are going after them wherever they are.”

In the lawsuit, the rifle association and Dr. Arie Friedman, a pediatrician and owner of semi-automatic weapons, contend that that Highland Park, where Friedman lives, did not have a legal right to ban the weapons that he says he keeps for the lawful purposes of target shooting and self-defense.

Further, the lawsuit suggests that by lumping in the kinds of semi-automatic weapons Friedman owns with fully automatic assault weapons, the ban infringes on the rights of people to possess one of the most commonly owned “sporting rifles” in the United States.

“Ownership of firearms that are commonly possessed by law-abiding citizens for lawful purposes … is a fundamental right under the Second Amendment of the United States Constitution,” according to the lawsuit…

Legal representatives for the City claim the ban passes constitutional muster.

Obviously, that’s not up to them to decide anymore.

In the meantime, I’m guessing legal fees for time and work spent on the issue will add up while other Illinois towns that enacted regulations/bans on these so-called “assault weapons” nervously monitor how the lawsuit plays out for the Lake County community.

Gun Registration Often Leads To Confiscation, As New Yorkers Find Out Once More

Why Gun Rights Advocates Oppose Gun Registration

A centralized registration system is the one usually proposed by gun control activists, and it is the type most feared by gun rights advocates. At the heart of resistance to registration is the belief that it encourages firearm prohibitions and ultimately leads to confiscation. (It is also why many choose not to comply and register weapons already owned.)

Those who favor more gun control often accuse gun owners of being paranoid, but the track record of firearms registration is not a good one.”

Supporters of more gun “control” in the United States routinely push for the registration of firearms.

And, “Don’t worry,” they like to say, “No one is going to take away your guns.”

Problem is, history repeatedly shows otherwise.

I blogged backed on January 14, 2013:

Gun registration often leads to confiscation. From the latest edition of Gun Facts, a popular firearm reference book:

Myth: Registration does not lead to confiscation

Fact: It did in Canada. The handgun registration law of 1934 was the source used to identify and confiscate (without compensation) over half of the registered handguns in 2001.
Fact: It did in Germany. The (before the Nazis came into power) required all firearms to be registered. When Hitler came into power, the existing lists were used for confiscating weapons.
Fact: It did in Australia. In 1996, the Australian government confiscated over 660,000 previously legal weapons from their citizens.
Fact: It did in California. The 1989 Roberti-Roos Assault Weapons Control Act required registration. Due to shifting definitions of “assault weapons,” many legal firearms are now being confiscated by the California government.
Fact: It did in New York City. In 1967, New York City passed an ordinance requiring a citizen to obtain a permit to own a rifle or shotgun, which would then be registered. In 1991, the city passed a ban on the private possession of some semi-automatic rifles and shotguns, and “registered” owners were told that those firearms had to be surrendered, rendered inoperable, or taken out of the city.
Fact: It did in Bermuda, Cuba, Greece, Ireland, Jamaica, and Soviet Georgia as well.

Now, you can add the “Big Apple” to that list for a second time. Edmund DeMarche reported on the FOX News website earlier today:

The New York City Police Department is taking aim at owners of shotguns and rifles capable of holding more than five rounds, demanding such guns be surrendered, altered or taken out of the city.

The demand came in the form of some 500 letters mailed out to owners of registered long guns that are in violation of a 2010 city ordinance. The first option for the letter’s recipient is to, “Immediately surrender your Rifle and/or Shotgun to your local police precinct, and notify this office of the invoice number. The firearm may be sold or permanently removed from the City of New York thereafter.”

Sound familiar?

Resource Of The Week: Pursuit Channel Free On FilmOn.com

Back when I lived in Chicago I used to have satellite television. And a few channels at that time carried firearm-related programming. One of these was the Pursuit Channel. From their website:

Chicago Mayor Rahm Emanuel And Police Superintendent Garry McCarthy Call For More Gun ‘Control’

The first anniversary of the Newtown, Connecticut, shootings is right around the corner, and supporters of gun “control” are becoming increasingly vocal about their desire for more restrictions. Not surprisingly, Chicago Mayor Rahm Emanuel and Chicago Police Department Superintendent Garry McCarthy chimed in yesterday with their calls for more gun “control” while celebrating the Brady Handgun Violence Prevention Act, or “Brady Bill,” which was signed into law on November 30, 1993, and required background checks be conducted on individuals before a firearm can be purchased from a federally-licensed dealer. C. Hayes wrote on Chicago’s WGN TV website Thursday:

Mayor Emanuel, Chicago Police Supt. Garry McCarthy, and the Illinois Association of Chiefs of Police, and the National Law Enforcement Partnership to Prevent Gun Violence mark the upcoming, 20th anniversary of an historic gun law while also pushing for even tougher gun rules in Chicago

At Thursday’s gathering, the leaders said the explosion of the internet has undermined the law. They point out up to 40 percent of firearms sales are through the internet between private parties

“While gun shows were around, they weren’t really conceived of in the way that they are today for purchases and moving of guns,” said Emanuel.

CPD Superintendent McCarthy had this to say about the group’s desire for universal background checks:

I think some people wrongly believe that requiring background checks will have no impact on criminals and will only create a system that impacts the good citizens who comply with the law. That couldn’t be further from the truth.

Speaking of “the truth,” back on March 21, 2013, FactCheck.org looked into the line that “40 percent of guns are purchased without a background check.” Here’s what they found:

That figure is based on an analysis of a nearly two-decade-old survey of less than 300 people that essentially asked participants whether they thought the guns they had acquired- and not necessarily purchased- came from a federally licensed dealer. And one of the authors of the report often cited as a source for the claim — Philip Cook of Duke University — told our friends at Politifact.com that he has “no idea” whether the “very old number” applies today or not.

Ironically, a number of FactCheck.org’s critics claim the fact-checking project is actually liberal-leaning, not unbiased as many might think.

Update On Illinois Legislation For Raising Mandatory Minimum Prison Sentences And Imposing Truth In Sentencing For Gun Crimes

“Illinois law already mandates a minimum 15-year sentence when a person with a gun commits any felony offense, and a one-year minimum for unlicensed gun possession and licensed possession of a loaded gun.”

-Illinois State Senator and Illinois Senate Criminal Law Committee member Patricia Van Pelt (D-Chicago), in a Chicago Tribune commentary, October 23, 2013

Here’s the latest on legislation at the state level that’s been backed by the Emanuel administration and Cook County State’s Attorney Anita Alvarez that would not only raise mandatory minimum prison sentences for gun crimes but would require offenders to serve 85 percent of their sentences. From the National Rifle Association’s Institute for Legislative Action earlier today:

The NRA-ILA has just learned that new changes to recent legislation aimed at imprisoning law-abiding Illinois citizens for a victimless crime will likely be proposed very soon. While no language is currently available for review, the NRA-ILA has obtained information that the proposed changes will eliminate any mandatory minimums from the legislation for first-time offenders of the Unlawful Use of Weapons (UUW) or Aggravated Unlawful Use of a Weapon (AUUW) statutes, with no aggravating factors such as previous felonies or gang membership.

However, current law provides that probation is not available as a sentencing option, so individuals would still be sentenced to jail time, for which they are required to serve at least 85 percent of their sentence. This policy change continues to create a scenario in which an unsuspecting citizen who has chosen to carry a firearm for self-defense, could serve significant jail time for a regulatory infraction.

So, to update a scenario that critics of this legislation have been putting out there, if a man with a concealed-carry permit left his firearm in his car because he and his spouse are going some place where guns are banned, and she leaves without him while taking the car, and subsequently gets pulled over by police, the spouse would still get slapped with a jail sentence since probation is not an option. At least that’s what I take away from all this.

Why the apparent insistence on punishing the “unsuspecting citizen”?

A number of observers suspect this is a conscious effort being carried out by anti-gun politicians in the state, hoping to make poster-children out of these unfortunate individuals and scare away other Illinois residents from exercising their Second Amendment right.

Chicago Ends Gun Registration, Firearms Permit Requirements

Gun rights advocates scored a significant, if not somewhat expected, victory in Chicago yesterday. Renita Young reported on the Reuters website last night:

Chicago on Wednesday reluctantly abolished a 45-year-old requirement that gun owners register their weapons with the city, marking a victory for advocates of gun rights such as the National Rifle Association.

The city council voted to end the gun registry in place since 1968 to comply with court rulings against Chicago and Illinois gun control laws, and to bring the city into line with a state concealed carry law…

Illinois approved a concealed carry law in July, giving control of gun regulations to the state and essentially nullifying Chicago’s power to require that gun owners register their weapons and have a city firearms permit.

The measures approved by a voice vote on Wednesday complied with the new state law. In addition to eliminating the gun registry, the measures eliminated the requirement for gun owners to have a Chicago firearm permit.

Ah yes, the notorious CFP. First, the City of Chicago required firearms kept within city limits to be registered. Then, on July 12, 2010, Chicago residents were required to obtain a Chicago Firearms Permit before they could register a firearm. Once all the initial costs were taken into account- $100 CFP application fee, $15 per firearm registration fee, around $100 for required, state-approved firearm training/safety class- Chicagoans who wanted to legally keep at least one gun in the city easily shelled-out over $200 to start.

Mind you, that doesn’t even include the cost of the firearm.

I have a pretty good idea what many pro-Second Amendment Chicagoans are thinking about the infamous gun registry and newer CFP having been eliminated.

Good riddance.

White House ‘Fact Sheet’ On New Gun ‘Control’ Initiatives

While many Americans are distracted by the possibility of American military intervention in Syria, U.S. President Barack Obama has announced new gun “control” initiatives. From the White House website today:

FACT SHEET: New Executive Actions to Reduce Gun Violence

Today, the Obama administration announced two new common-sense executive actions to keep the most dangerous firearms out of the wrong hands and ban almost all re-imports of military surplus firearms to private entities. These executive actions build on the 23 executive actions that the Vice President recommended as part of the comprehensive gun violence reduction plan and the President unveiled on January 16, 2013.

Even as Congress fails to act on common-sense proposals, like expanding criminal background checks and making gun trafficking a federal crime, the President and Vice President remain committed to using all the tools in their power to make progress toward reducing gun violence.

Building on the 23 Executive Actions the President and Vice President Unveiled Last January

• Last December, the President asked the Vice President to develop a series of recommendations to reduce gun violence. On January 16, 2013, they released these proposals, including 23 executive actions. With the first Senate confirmation of an ATF Director on July 31, 2013, the Administration has completed or made significant progress on 22 of the 23 executive actions. The new executive actions unveiled today build on this successful effort.

Closing a Loophole to Keep Some of the Most Dangerous Guns Out of the Wrong Hands

• Current law places special restrictions on many of the most dangerous weapons, such as machine guns and short-barreled shotguns. These weapons must be registered, and in order to lawfully possess them, a prospective buyer must undergo a fingerprint-based background check.
• However, felons, domestic abusers, and others prohibited from having guns can easily evade the required background check and gain access to machine guns or other particularly dangerous weapons by registering the weapon to a trust or corporation. At present, when the weapon is registered to a trust or corporation, no background check is run. ATF reports that last year alone, it received more than 39,000 requests for transfers of these restricted firearms to trusts or corporations.
• Today, ATF is issuing a new proposed regulation to close this loophole. The proposed rule requires individuals associated with trusts or corporations that acquire these types of weapons to undergo background checks, just as these individuals would if the weapons were registered to them individually. By closing this loophole, the regulation will ensure that machine guns and other particularly dangerous weapons do not end up in the wrong hands.

Keeping Surplus Military Weapons Off Our Streets

• When the United States provides military firearms to its allies, either as direct commercial sales or through the foreign military sales or military assistance programs, those firearms may not be imported back into the United States without U.S. government approval. Since 2005, the U.S. Government has authorized requests to reimport more than 250,000 of these firearms.
• Today, the Administration is announcing a new policy of denying requests to bring military-grade firearms back into the United States to private entities, with only a few exceptions such as for museums. This new policy will help keep military-grade firearms off our streets.

Democratic Congressmen Push For 20 Percent Federal Excise Tax On Firearms, 50 Percent Tax On Ammo

Back when Danny Davis (D-IL) was my congressman, I don’t recall hearing too much from him- unless he was coming up for re-election.

Well, November 4, 2014, is fast-approaching, and he and another Democratic congressman- William Pascrell (D-NJ)- whose seat is up for election have both decided to take it upon themselves to remind Americans that Democrats stand for gun “control.”

You see, Representatives Davis and Pascrell introduced HR 3018- the “Gun Violence Prevention and Safe Communities Act”- last week, which would hike federal excise taxes on firearms from 10-11 percent up to 20 percent, and hike taxes on ammunition from 11 percent to 50 percent.

I’m guessing a number of pro-gun Democrats, especially those holding office whose seats are also up for election in 2014, are livid right now.

From GovTrack.us this evening:

A BILL

To amend the Internal Revenue Code of 1986 to increase the excise tax and special occupational tax in respect of firearms and to increase the transfer tax on any other weapon, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘Gun Violence Prevention and Safe Communities Act of 2013’.

SEC. 2. INCREASE IN EXCISE TAXES RELATING TO FIREARMS.

(a) In General- Section 4181 of the Internal Revenue Code of 1986 is amended to read as follows:

‘SEC. 4181. IMPOSITION OF TAX.

‘There is hereby imposed upon the sale by the manufacturer, producer, or importer of the following articles a tax equivalent to the specified percent of the price for which so sold:

‘(1) Articles taxable at 20 percent:

‘(A) Pistols.

‘(B) Revolvers.

‘(C) Firearms (other than pistols and revolvers).

‘(D) Any lower frame or receiver for a firearm, whether for a semiautomatic pistol, rifle, or shotgun that is designed to accommodate interchangeable upper receivers.

‘(2) Articles taxable at 50 percent: Shells and cartridges.’.

HR 3018 would also increase the transfer tax on firearms covered under the National Firearms Act (“machine guns,” for example) from $200 to $500 and the transfer tax on all other guns from $5 to $100.

Other blogs/websites are reporting that besides ammo, this legislation hikes just handgun- not long gun- taxes, but based on the following- “Firearms (other than pistols and revolvers)”- I take this to mean rifles and shotguns as well.

Consider the following analysis of the gun “control” legislation by Michael Cohn over at AccountingToday.com:

The bill, known as the Gun Violence Prevention and Safe Communities Act, is co-sponsored by Rep. Bill Pascrell, Jr., D-N.J., and Danny Davis, D-Ill. It would increase the excise taxes on firearms from the current range of 10 percent to 11 percent and raise it to 20 percent. The bill would also increase the excise tax on ammunition from 11 percent to 50 percent. It would also increase the Special Occupational Tax on firearm importers, manufacturers and dealers; include assault pistols in the definition of firearms covered under the National Firearms Act; increase the transfer tax on all weapons (except antique guns) covered under the National Firearms Act (excludes most common guns) from $200 to $500 and index to inflation; and increase the transfer tax for any other weapon from $5 to $100 and index to inflation.

All government agencies would be exempted from the tax, including federal, state and local agencies, such as police departments.

Here’s my analysis. The legislation won’t become law. And I think Congressmen Davis and Pascrell know that.

But it did get them some valuable face time for next year’s election.
