Bills Filed To Scrap Illinois FOID Card

In the state of Illinois, unless specifically exempted by statute, any Illinois resident who acquires or possesses firearm or firearm ammunition within the State must have in their possession a valid Firearm Owner’s Identification (FOID) card issued in his or her name. The FOID card was created in 1968 by the Firearm Owners Identification Card Act (430 ILCS 65), and the Illinois State Police is tasked with identifying those persons eligible to acquire/possess these items.

James Stratton reported on the website of KWQC-TV 6 (Quad Cities) Thursday night:

Two bills have been filed in the Illinois Legislature to repeal the Illinois Firearm Owner Identification Act.

Senate Bill 1324 was filed by State Senator Neil Anderson Thursday, and House Bill 0492 was filed last week to do the same.

“In my opinion,and the opinion of a lot of people, the FOID card is nothing more than a cash grab for the state of Illinois,” said Senator Anderson (R) of Moline…

Senator Anderson says the law is redundant, and an infringement of Second Amendment rights.

“When I, in Illinois, go buy a firearm, I have to go through the same federal background check, in addition to having the FOID card,” Anderson added…

I’m not too sure what the likelihood is the Firearm Owners Identification Card Act will be repealed.

If anything, I suspected Springfield was going to hike the price of the FOID card considering the dire financial straits the state is in.

It was reported on the Fox 32 (Chicago) website Monday morning that 8 people were killed and at least 20 others wounded in shootings across the city. According to the HeyJackass! website this afternoon, the “Windy City” has tallied 2,750 shootings and 464 homicides year-to-date. Yikes.

‘Magnificent Mile’ Retailers Say Protest On Black Friday Resulted In Sales ‘25 Percent To 50 Percent Below Projections’

Kim Janssen reported on the Chicago Tribune website Monday afternoon:

Activists who blocked the entrances to stores on North Michigan Avenue on Black Friday to protest the fatal shooting of a black teenager by a white Chicago cop may have split opinions with their tactics.

But their goal of forcing retailers to suffer economic pain on what’s historically the busiest shopping day of the year was a success, according to unhappy store staff and managers who said Monday that Black Friday sales on the Magnificent Mile were 25 percent to 50 percent below projections

Illinois State Rifle Association Issues ‘Urgent Alert’ On Prepping For Terrorism

While I haven’t been following the activities of the Illinois State Rifle Association for long, I don’t think I’ve ever seen them this worked up about such an issue. From a November 14 Facebook post:

People around the world were treated today to a brutal spectacle having its roots in political naivety, ignorance of history, and wholly misguided immigration policy. Does that sound familiar? It should, because it aptly describes not only to the French government, but the sitting U.S. administration as well.

If you are of the mind of, “…it can’t happen here” then you are sorely deluded. The apparatus to launch a Paris-style bloodbath is already in place here in the United States. All these determined terrorists are waiting for is the go-head from their higher headquarters.

1. Make sure every person in your family holds a FOID card and that all eligible family members hold Illinois concealed carry permits.
2. Assemble a family defense arsenal consisting of one or more semiautomatic rifles such as the AR-15; one or more 12-gauge pump action shotguns, and one or more semiautomatic handguns. If you do not have a family defense arsenal, this is a good weekend to begin putting it together.
3. Be sure that you and every member of your family have had sufficient training in the use and field servicing of the weapons in your family defense arsenal.
4. Be sure that you have sufficient quantities of the proper ammunition on hand to defend your family.
5. Resolve this weekend to get yourself and your family into a physical training regimen. Your physical conditioning may be the difference between life and death during a Paris-style attack.
6. Encourage your extended family and friends to develop plans for protecting self and family from the threat of terror our government takes so lightly.

You have to understand that this is not a battle you can hire someone else to fight for you. When the time comes, you may very well find yourself standing nose to nose with a guy intent upon obliterating you, your culture, and everything you hold sacred.

Are you prepared?

Disturbing. Yet nothing to scoff at, as I too believe it’s only a matter of time before a major terror attack is launched by jihadists against the U.S.

Cook County Ammo Tax Ordinance To Be Heard Friday, November 13

Within yesterday’s SP Intel Report, I mentioned that Cook County President Toni Preckwinkle is proposing a tax on ammunition sales in the county. The National Rifle Association’s Institute for Legislative Action reported on its website Monday:

Cook County Board of Commissioners has proposed Ordinance 15-6469, a proposal to impose a tax on ammunition, similar to proposals reported on in the past. This ordinance will be heard on Friday, November 13, at 1:00 p.m., by the Cook County Board of Commissioners Finance Committee.

This proposal would impose a $0.05/cartridge tax on all centerfire ammunition and a $0.01/cartridge tax on all rimfire ammunition, and would therefore penalize law-abiding gun owners for exercising their fundamental right to keep and bear arms. By definition, holders of a valid FOID card are the only persons legally permitted to purchase ammunition in Illinois, and therefore are the only persons subject to this tax – not the criminals responsible for the violence on the streets of Chicago…

Wisconsin Democrats Push To Ban ‘Semiautomatic Assault Weapons’

The push for more gun “control” is alive and well north of the Illinois state line too. From a press release published on the Urban Milwaukee website last Wednesday by Wisconsin State Representative Lisa Subeck (D-Madison):

MADISON –Today, Representative Subeck (D-Madison), along with Representatives Terese Berceau, Melissa Sargent and Chris Taylor, circulated an Assembly bill that would ban the transportation, purchase, possession, or transfer of semiautomatic assault weapons in Wisconsin.

“Our nation has watched as community after community has had to confront the tragedies that occur when weapons designed to kill large numbers of people quickly get into the hands of a dangerous person,” said Representative Lisa Subeck. “No Wisconsin community should ever have to face such a tragedy at the hands of someone armed with a semiautomatic assault weapon.”

Semiautomatic assault weapons are a class of firearms that are designed to kill large numbers of people quickly. They have been used in many high-profile shooting incidents, including the 2012 mass shooting at Sandy Hook Elementary School in Newtown, Connecticut; the 2012 Aurora, Colorado movie theater shooting; the 1999 Columbine High School massacre in that state; and the 1993 office shooting at the 101 California Street building in San Francisco.

“I can conceive of no legitimate reason that any citizen should need to own or use a semiautomatic assault weapon,” said Rep. Subeck…

Former U.S. Comptroller General David M. Walker Warns Real U.S. Debt Closer To $65 Trillion Than $18 Trillion

It’s been some time since I’ve blogged about former Comptroller General of the United States David M. Walker. Appointed by President Clinton, Walker served as Comptroller General and head of the Government Accountability Office from 1998 to 2008. While at the GAO, Walker warned Americans about the nation’s long-term fiscal challenges as part of the “Fiscal Wake-Up Tour.” Frustrated by Washington’s refusal to confront these challenges, Walker left the public sector on March 12, 2008. I noticed Mr. Walker was back in the headlines this past weekend. Bradford Richardson reported on The Hill website Saturday:

The former U.S. comptroller general says the real U.S. debt is closer to about $65 trillion than the oft-cited figure of $18 trillion.

Dave Walker, who headed the Government Accountability Office (GAO) under Presidents Bill Clinton and George W. Bush, said when you add up all of the nation’s unfunded liabilities, the national debt is more than three times the number generally advertised.

“If you end up adding to that $18.5 trillion the unfunded civilian and military pensions and retiree healthcare, the additional underfunding for Social Security, the additional underfunding for Medicare, various commitments and contingencies that the federal government has, the real number is about $65 trillion rather than $18 trillion, and it’s growing automatically absent reforms,” Walker told host John Catsimatidis on “The Cats Roundtable” on New York’s AM-970 in an interview airing Sunday…

Proposed Niles Gun Shop And Range Hits A Snag

While I was away from the blog, I heard a new gun shop and shooting range might be opening in the northwest Chicago suburb of Niles, near my old stomping grounds in the city.

But according to various news outlets today, the project has hit a snag.

From the WGN web site:

Village Board members were going to vote on the gun shop’s permit Tuesday night, but they sent the measure back to the zoning board for further discussion.

The zoning board will hold a hearing on July 7.

Reporter Tom Robb added over on the Journal & Topics Newspapers website:

Niles officials recently changed their zoning code to place gun related businesses in the industrial area of the village. Opponents say the proposed gun shop at 6143 Howard St. would provide easy access to guns and would be close to several schools, in some cases within blocks, recreational locations geared toward children, residential and educational centers for children with developmental disabilities and at least one bar…

I wonder what serves as the basis for “opponents” making that “easy access” claim?

Is it some perceived facility design flaw? Or do they think anyone can just waltz right into an Illinois gun shop, buy a firearm, and take it home with them the same day?

If so, they’ve obviously never bothered to educate themselves regarding the process for purchasing a gun from such a shop here in the “Land of Lincoln.”

You see, there’s this thing called a “waiting period.” Plus an FBI NICS background check that needs to be passed. Not to mention an initial background check performed by the Illinois State Police when the required Firearm Owner’s Identification (FOID) card is applied for.

“Easy access?” I don’t think so.

Robb noted the issue could come back before Niles trustees in late July.

Chicago Gangs Completely Out Of Control?

“Mayor Rahm Emanuel today decried the weekend violence that left at least nine people dead and at least 36 wounded in Chicago, calling for adults around the city to instill the right values in their children and to stand up for the safety of their neighborhoods…”

This past weekend, I read some interesting takes on the Chicago-area violence from individuals much closer to it than most. Billy Briggs of the The Daily Telegraph (UK) wrote Saturday:

It’s an opinion I hear later from another gangbanger with the Black P Stones. The Stones are one of the Latin Kings’ rivals and have about 30,000 members.

In the suburb of Maywood on the city’s west side, I interviewed an ex-con called Anthony, better known on the streets by his nickname, Chopper, an allusion to his role in cutting illegal drugs before distribution…

He says Chicago’s latest problems are a result of gang discipline breaking down and the rise of a new generation of gangbangers who are completely out of control.

All the structure in the gangs is gone, so there is no leadership. There is so much shooting going on, nobody knows where to turn. It ain’t the older guys, it’s the young guys, as young as 13. It wasn’t like that in the 80s or 90s. This is new. Some of these guys just shoot for fun.”

This perceived lack of structure and leadership was also highlighted in a different Chicago gang piece that appeared on The Guardian (UK) website this weekend. John Swaine discussed the recent shooting death of area rapper Mario Hess aka “Blood Money” and “Big Glo,” and reported Saturday:

In the 1990s, the aggressive jailing of gang leaders left behind a more fractured setup that is even more difficult to control.

“Back then, two of the heads could stand up and say ‘OK: enough, we gonna have a peace treaty,’” said Renaldo Hess, 43, who managed Blood Money before his murder last week.

“Now, it’s much more chaotic.”

So the jailing of gang leaders created an environment today in the Chicago-area gangs where structure and discipline is severely lacking. Toss in some feral urban youth into the mix- and the rampant gang-related violence that’s constantly in the local news these days makes a lot more sense.

Kind of messed up we have to hear that from individuals on/around the inside and from overseas publications.

Whereas here in the Chicago area, all we ever get from the politicians, their disciples, and their presstitutes is that a lot of the violence comes from not enough gun “control.”

Yet, I’d be surprised to find out if even one FOID card holder was involved in any of that carnage over the past weekend.

New Gun ‘Control’ Laws For State Of Illinois

It was all over the Chicago-area news this past weekend:

On Sunday, Illinois Governor Pat Quinn (D-Chicago) signed into law House Bill 1189 (sponsored by State Representative Mike Zalewski (D-Riverside) and State Senator Kwame Raoul (D-Chicago)), the “Gun Safety and Responsibility Act,” requiring firearm owners in the state to report missing firearms to police and initiate background checks on potential buyers.

Mitch Smith reported on the Chicago Tribune website Monday morning:

Starting immediately, gun owners whose weapons are lost or stolen will have 72 hours to notify police. And beginning Jan. 1, individual gun owners will have to contact the Illinois State Police before selling a weapon or transferring ownership to ensure that the purchaser is allowed to have a gun.

Quinn said the legislation closes a loophole in the state’s gun laws, which previously required gun show merchants and licensed firearms dealers — but not private sellers — to check that the customer had a valid firearm owner’s identification card. Under the new law, private sellers must contact state police, who will then search records and determine the prospective buyer’s eligibility.

Besides contacting the Illinois State Police for a background check on potential buyers beginning next year, those transferring/selling a gun will be required to do some recordkeeping on behalf of the law enforcement agency once the handover is complete. From the bill’s text:

Section 5. The Firearm Owners Identification Card Act is amended by changing Sections 3, 3.3, and 8 as follows…

(b) Any person within this State who transfers or causes to be transferred any firearm, stun gun, or taser shall keep a record of such transfer for a period of 10 years from the date of transfer. Such record shall contain the date of the transfer; the description, serial number or other information identifying the firearm, stun gun, or taser if no serial number is available; and, if the transfer was completed within this State, the transferee’s Firearm Owner’s Identification Card number and any approval number or documentation provided by the Department of State Police pursuant to subsection (a-10) of this Section. On or after January 1, 2006, the record shall contain the date of application for transfer of the firearm. On demand of a peace officer such transferor shall produce for inspection such record of transfer. If the transfer or sale took place at a gun show, the record shall include the unique identification number. Failure to record the unique identification number or approval number is a petty offense.

And what happens to firearms owners in the state if they fail to report the theft of their guns within the allotted 72 hours? The “Gun Safety and Responsibility Act” says:

Sec. 24-4.1. Report of lost or stolen firearms…

(d) Sentence. A person who violates this Section is guilty of a petty offense for a first violation. A second or subsequent violation of this Section is a Class A misdemeanor.

I don’t know about you, but something tells me this new gun “control” law isn’t going to do much to stem the shooting and killing going on in Chicagoland and elsewhere in the “Land of Lincoln” these days.

Why’s that? Because the jokers behind the shooting and killing don’t exactly acquire their firearms through “normal” channels on a routine basis.

If the shooters aren’t bringing the “five-finger discount” into play to get their guns, their street suppliers certainly don’t give a rat’s butt about FOID cards and “the prospective buyer’s eligibility.”

Several Chicago Suburbs Consider ‘Assault Weapon’ Bans As Result Of State Concealed-Carry Legislation

Several Chicago-area municipalities are considering bans on so-called “assault weapons” as a result of concealed-carry legislation that’s been passed by the Illinois General Assembly and is awaiting signature by Governor Pat Quinn. From an e-mail I received yesterday from the National Rifle Association’s Institute for Legislative Action:

Illinois: Localities Attempting to Enact Anti-Gun Ordinances in Anticipation of Firearms Preemption Law

Your NRA-ILA has learned recently that some localities in Illinois are scrambling to consider bans on popular semi-automatic firearms while House Bill 183 awaits consideration of Governor Pat Quinn (D). If enacted into law, House Bill 183 will contain comprehensive preemption of handgun-related local ordinances for anyone with a FOID card and reserves regulation of all laws relating to the concealed carrying of handguns to the state. It also provides protections to those traveling with firearms by providing comprehensive preemption of local ordinances as applied to individuals with a FOID card who are transporting firearms in compliance with all state regulations. Firearms preemption prevents lawful concealed carry licensees and firearm owners from being caught in a web of confusing local ordinances and laws as they go about their daily routines. However, HB 183 contains a provision that allows certain localities up to ten days from the date of enactment to make laws prohibiting so-called “assault weapons” before this legislation prohibits local governments from doing so at a later date.

Quinn has been granted an extension of thirty days by a federal court to consider signing HB 183,leaving ample time for localities to enact anti-gun ordinances.

Some of these localities include:

Buffalo Grove
Evanston
Highland Park
Orland Park
Wheeler (Editor’s note: I believe the NRA-ILA meant Wheeling)

While handgun laws will be preempted for those with a FOID card under HB 183, its language of past bans on “assault weapons” could include popular and commonly used handguns and circumvent this firearms preemption. Serious concerns still exist about the potential loopholes and legal issues in House Bill 183.

NRA members are urged to contact your local government officials and respectfully urge them to OPPOSE any ordinance that would restrict the rights of law-abiding Illinois citizens or hinder their right to self-defense. Stay tuned to NRA-ILA for updates.

Illinois State Rifle Association’s Synopsis Of Illinois Concealed-Carry Bill

Interested in finding out what’s in the Illinois concealed-carry bill that was recently passed in the Illinois General Assembly (now awaiting Governor Pat Quinn’s signature) without having to pour over all the legalese?

Well, this morning I came across a synopsis of Illinois House Bill 183 (as amended) from the Illinois State Rifle Association on the shooting sports news website AmmoLand.com. ISRA Executive Director Richard Pearson wrote Wednesday:

Many of you have been asking what the bill contains – below is a brief outline. This synopsis of HB1083 is not legal advice.

Regulations:

• One statewide shall-issue licensing standard.
• With regard to concealed carry licenses, preempts local authority of governments to regulate handguns and ammunition for handguns, including licensing, registration, and transportation.
• With regard to FOID card holders, preempts local governments from regulating the transportation of all firearms and ammunition.
• Not preempted are AWB enacted prior to or within 10 days of the enactment of this legislation – after that date, new AWBs would be preempted. Local governments could still regulate rifles and shotguns, but not handguns.
• Grants “safe haven” protection for people carrying concealed while in their vehicle even in prohibited areas.
• Upon exit from their vehicle, the firearm must be locked in their vehicle. If they wish to lock their firearm in their trunk, it must be unloaded before exiting the vehicle.
• License to be issued by the Illinois State Police.
• $150.00 fee for 5 years.
• Requires 16 hours of training, including range time. Up to 8 hours of credit will be recognized for those who had hunter safety, was honorably discharged from the military, or had other CCW training. At this time, states with shorter training time, such as Utah, may only be credited 4 hours. The administrative rules of what the allowances will be, have not yet been determined.
• Private property owners can post their property prohibiting concealed carry. “Safe haven” still applies to their parking lots.
• Restaurants with 50% or more of their receipts from food, but still serving alcohol, are legal to carry in, but are still subject to private property posting by the owners or operators.
• Law enforcement may object to a person they believe to be a “clear and present danger” to themselves or others. Applicants can appeal that decision to the Concealed Carry Licensing Board.
• The State Police have 180 days from the effective date of this bill to be set up to begin processing applications.
• Within 60 days of the effective date of this bill, the Illinois State Police shall begin approval of firearm training courses and instructors.
•There is no reciprocity, but “safe haven” applies to out of state concealed carry permit holders.

Cook County Sheriff Proposing $300 ‘May Issue’ Concealed-Carry Permits If State Misses Deadline

As Illinois state legislators scramble to enact a concealed-carry law after a federal appeals court required one to be in place by June 9, the top law enforcement officer in Cook County is proposing his own CCW legislation. Frank Main reported on the Chicago Sun-Times website last night:

Sheriff Tom Dart said Sunday that he is proposing a concealed-carry gun ordinance to keep Cook County from becoming the “Wild West.”

Dart said he’s worried about a stalemate in the General Assembly on a law to license people to carry concealed guns. If legislators don’t meet a June 9 court deadline to pass such a law, anyone with a state firearm owner’s identification card could legally walk anywhere in public with a concealed weapon, Dart said…

Dart’s ordinance would give him the power to approve and reject licenses to carry concealed guns in Cook County. Applicants would have to pay a $300 fee for a license.

However, I predict there’s a good chance concealed-carry legislation will be enacted in the state by that June deadline.

If not, something will be patched together quick… after perceived political opportunities are exploited and exhausted, of course.

Illinois Could Become ‘Constitutional Carry’ State On June 10

There’s a chance Illinois may become the newest “Constitutional carry” state on June 10.

Yep. You read that right.

Lauren Leone-Cross reported on the The State Journal-Register (Springfield, Illinois) website last night:

Another attempt to pass a concealed-carry bill fell seven votes short in the Illinois House Thursday night, raising questions about whether legislators can meet a court-ordered June 9 deadline to enact a law.

The vote was 64-45 in favor of House Bill 997, which is supported by gun-rights advocates.

However, the bill needed a supermajority of 71 votes to pass because it would pre-empt the home-rule authority of municipalities to establish their own concealed-carry rules and set a single, statewide standard.

Sponsoring Rep. Brandon Phelps, D-Harrisburg, used a parliamentary maneuver to keep the bill alive for a possible second vote in the future.

Afterward, Phelps stressed the federal appellate court decision in December that struck down Illinois’ last-state-in-the-nation ban on concealed-carry. If lawmakers do not act by the deadline, the ban goes away and there will be no restrictions as to where a person can carry a loaded weapon in public.

Enter Constitutional carry, also known as “permitless carry” and “Vermont carry.” By definition, it means carrying a concealed handgun without a concealed-carry permit.

And it’s something that could happen by default in the “Land of Lincoln” on June 10 if state legislators don’t enact a concealed-carry law after a federal appeals court required Illinois to put one in place by June 9.

Dave McKinney (with reporting by Zach Buchheit) published on the Sun-Times Politics blog last night what National Rifle Association lobbyist Todd Vandermyde said in a Q&A session late Thursday with the Illinois Statehouse press corps after the NRA-backed concealed-carry legislation suffered that setback. From a transcript:

Q: What happens on June 9?
A: “If nothing happens, the likelihood is that we’re going to have a court injunction. And if you’ve got a valid FOID card, you’re going to be able to carry a firearm in this state. The court won’t write a carry law. They have a very specific purpose, and that is to find the UUW statute in the state of Illinois unconstitutional and issue an injunction against the state’s enforcement of that law. That’s the court’s role in this. Then you might see some municipalities try to do their own thing but they are likely to face the same hurdles that the state has.”

For once, Firearm Owner’s Identification (FOID) card holders in Illinois might be able to crack a smile.

However, I predict there’s a good chance concealed-carry legislation will be enacted in the state by that June deadline.

If not, something will be patched together quick… after perceived political opportunities are exploited and exhausted, of course.
